These Terms of Service ("Terms") govern your access to and use of the CROgrader website at crograder.com and all related services, tools, and digital products (collectively, the "Service"). By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

1. Service Description

CROgrader provides an AI-powered conversion rate optimization (CRO) scanning tool that analyzes websites across multiple conversion factors and generates actionable recommendations. The Service includes:

• Free CRO scanner — A tool that analyzes publicly accessible web pages and generates a conversion optimization report.
• Paid digital products — Guides, templates, courses, and other digital resources related to conversion rate optimization, available for purchase through the website.

2. Eligibility

You must be at least 16 years of age to use the Service. By using CROgrader, you represent and warrant that you meet this age requirement and have the legal capacity to enter into these Terms.

3. Account and Access

Certain features of the Service, such as accessing scan reports, may require you to provide an email address. You are responsible for providing accurate information and maintaining the security of any account credentials associated with your use of the Service.

4. Acceptable Use

You agree to use the Service only for lawful purposes and in accordance with these Terms. You agree not to:

• Submit URLs of websites that you do not own or have authorization to analyze, where such analysis would violate applicable law.
• Use the Service to scan websites for malicious purposes, including but not limited to competitive sabotage or harassment.
• Attempt to reverse-engineer, decompile, or extract the underlying algorithms, models, or source code of the Service.
• Use automated scripts, bots, or crawlers to access the Service in a manner that exceeds reasonable use or places undue burden on our infrastructure.
• Resell, redistribute, or commercially exploit scan reports or any output of the Service without our prior written consent.
• Interfere with or disrupt the integrity or performance of the Service or its related systems.
• Violate any applicable local, national, or international law or regulation.

5. Intellectual Property

5.1 Our Content

All content on CROgrader, including but not limited to text, graphics, logos, icons, images, scan algorithms, report formats, blog articles, digital products, and software, is the property of CROgrader or its licensors and is protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, sell, or lease any part of our content without our prior written consent.

5.2 Scan Reports

Scan reports generated by the Service are provided for your personal or internal business use. You may share individual scan reports with colleagues, clients, or stakeholders. You may not systematically generate and redistribute scan reports as a competing service.

5.3 Digital Products

Paid digital products are licensed to you for personal or internal business use upon purchase. You may not redistribute, resell, or share purchased digital products with third parties unless explicitly permitted by the product license terms.

5.4 Your Content

You retain ownership of any URLs and website content you submit to the Service. By submitting a URL, you grant CROgrader a limited, non-exclusive license to access and analyze the publicly available content of that URL for the purpose of delivering the scanning service.

6. AI-Generated Analysis

CROgrader uses artificial intelligence (including the Anthropic Claude API) to analyze websites and generate recommendations. You acknowledge and agree that:

• AI-generated recommendations are suggestions based on automated analysis and should not be considered professional consulting advice.
• Results may vary and are not guaranteed to improve your conversion rates.
• You are solely responsible for any changes you make to your website based on scan recommendations.
• AI analysis has inherent limitations and may not capture all relevant factors affecting your website's performance.

7. Pricing and Payments

The CRO scanning tool is provided free of charge. Paid digital products are offered at prices displayed on the website at the time of purchase. All prices are in the currency indicated and include applicable taxes where required. We reserve the right to change pricing at any time, but changes will not affect orders already completed.

8. Refund Policy

Due to the digital nature of our paid products, all sales are final unless the product is materially defective or significantly not as described. If you believe a purchased product is defective, contact us at paulo@crograder.com within 14 days of purchase for review.

9. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

We do not warrant that:

• The Service will be uninterrupted, timely, secure, or error-free.
• The results obtained from the Service will be accurate, reliable, or complete.
• Any defects in the Service will be corrected.

CROgrader is a diagnostic tool, not a substitute for professional CRO consulting. Implementation of any recommendations is at your own risk and discretion.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, CROGRADER AND ITS OWNER, EMPLOYEES, AGENTS, AND AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICE.

Our total cumulative liability for all claims arising from or related to the Service shall not exceed the amount you paid to CROgrader in the twelve (12) months preceding the claim, or fifty euros (EUR 50), whichever is greater.

11. Indemnification

You agree to indemnify and hold harmless CROgrader and its owner from any claims, damages, losses, liabilities, and expenses (including legal fees) arising out of or related to your use of the Service, your violation of these Terms, or your violation of any rights of a third party.

12. Termination

We may suspend or terminate your access to the Service at any time, with or without cause, and with or without notice. Upon termination, your right to use the Service ceases immediately. Sections of these Terms that by their nature should survive termination will remain in effect, including intellectual property, disclaimers, limitation of liability, and indemnification.

13. Modifications to the Service

We reserve the right to modify, suspend, or discontinue any part of the Service at any time without prior notice. We shall not be liable to you or any third party for any modification, suspension, or discontinuation of the Service.

14. Changes to These Terms

We may update these Terms from time to time. Any changes will be posted on this page with an updated revision date. Your continued use of the Service after changes are posted constitutes your acceptance of the revised Terms.

15. Governing Law and Jurisdiction

These Terms are governed by and construed in accordance with the laws of the Netherlands. Any disputes arising from or related to these Terms or the Service shall be subject to the exclusive jurisdiction of the competent courts in Rotterdam, the Netherlands.

If you are a consumer residing in the European Union, you may also be entitled to invoke the mandatory consumer protection laws of your country of residence, and you may bring legal proceedings in the courts of that country.

16. Severability

If any provision of these Terms is found to be unenforceable or invalid by a court of competent jurisdiction, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

17. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and CROgrader regarding your use of the Service and supersede any prior agreements.
